GENERAL
1. These campaign conditions apply to the ‘share your advice’ campaign, hereinafter referred to as the ‘SYA campaign’, organised by Lely International N.V., Cornelis van der Lelylaan 1, 3147 PB Maassluis, hereinafter referred to as ‘Lely’.
2. The aim of this campaign is for Lely clients to share their advice with Lely and other farm managers for the improvement of all.
3. The campaign conditions are available on experts.lely.com
4. By participating in the SYA campaign, participants are deemed to be aware of the campaign conditions. Participants also confirm their agreement with the campaign conditions, the privacy statement and the disclaimer as found on experts.lely.com.
CONDITIONS OF PARTICIPATION
1. Participation in the competition is only possible through the internet and it is open solely to Lely clients based in France, the Netherlands, Ireland, Belarus, Germany, England, Poland, the Czech Republic, Slovakia, Russia, Switzerland, Belgium, Luxembourg, Italy, Norway, Sweden, Denmark, Iceland, Estonia, Finland, Cyprus, USA, Canada, Spain, Portugal, Japan and Korea. Applications from Lely clients in other countries will not be accepted.
2. In accordance with 2.1. participants must be over eighteen years of age. Lely employees are excluded from participation.
3. Underage participants who fulfil the conditions of 2.1 may participate in the SYA campaign once consent is expressed from one of their parents or guardians. Underage participants who take part will be deemed by Lely to have received parental/guardian consent. Underage participants who are unable to provide evidence of such consent can be excluded from further participation in the SYA campaign or their right to a prize can be withdrawn.
4. Participants who are not Lely clients can be excluded from further participation in the SYA campaign or their right to a prize can be withdrawn.
5. Participants are prohibited from sending in worms, viruses or other destructive software under penalty of termination of their participation in the SYA campaign.
6. Submissions entered before or after the campaign period shall not be accepted or considered eligible for a prize under any circumstances whatsoever.
SYA CAMPAIGN PROCESS
1. There are two campaign periods for the SYA campaign. The campaign period for a particular country runs from 11 November 2014 to 26 February 2015, 00:00 CET, and is hereinafter referred to as the ‘country competition’. The worldwide campaign period is subsequent to the country competition and runs from 13 March to 10 April 2015, 00:00 CET, and is hereinafter referred to as the ‘global competition’.
  
  Country competition
2. Participants can upload their best advice and tips relating to automation through experts.lely.com. The type of file uploaded can be a photograph with a description (max. fifty words) or a short video/film of max. one minute. Any submission not meeting these conditions will not be accepted. Once the submission is correctly uploaded, the participant will receive an e-mail confirmation. Uploads can be made for the entire duration of the country competition.
3. In the uploads, participants must specify the country they are located in. All submissions that meet the campaign conditions will be carefully assessed by the local Lely staff. Every submission will be reviewed for personal details and content. If a submission has sufficient content, it will be approved by Lely and published on the website experts.lely.com, with a notification to the participant thereof. If a submission is withdrawn at Lely’s discretion, it shall not be published on experts.lely.com. In such a case, the participant will be notified by e-mail. Lely reserves the right not to indicate reasons for withdrawal of the submission.
4. When a submission is published on experts.lely.com, the participant in question is automatically entered in to a competition in the country in which the participant is located. On the closing date of the country competition, one winner will be selected from each country. The winner will be selected impartially on the basis of the content of the submission. The winner will be contacted by Local Lely staff within four weeks of the end of the campaign period for the country competition.
  
  Global competition
5. Every winner of a country competition will automatically be entered in to the global competition. Lely will take care of the translation of the submissions into English where necessary. The winner of the global competition will be selected by the visitors to experts.lely.com. Visitors can decide which advice they consider the most valuable by clicking ‘like’.
6. The submission with the most ‘likes’ on Friday 10 April 2015 at 00:00 CET will be the winner of the global competition. The winner of the global competition will be contacted by Lely within four weeks of the closure of the global competition.
PRIZES
1. The winners of the country competition and the global competition of the SYA campaign will be published on experts.lely.com.
2. The winners of the country competition will receive a voucher for EUR 500 to spend on their next order of a Consumables pack from Lely Consumables B.V.
3. The winner of the global competition will in addition receive a Consumables pack to a value of EUR 2,500 to be ordered from Lely Consumables B.V.
4. Lely can cancel or withdraw a prize at any time for production or content reasons or because of safety considerations or other reasons of force majeure.
5. Prizes can under no circumstances be exchanged for other prizes. Prizes are not transferable to third parties.
6. Prizes may be valid for a restricted period of time.
LIABILITY
1. By participating in this competition, participants confirm their agreement with the full content of the campaign conditions and the method of notification. Lely’s results and decisions may not be challenged for any reason whatsoever.
2. Lely may under no circumstances be held liable for accidents, costs and direct or indirect damage of any nature whatsoever that could ensue from participation in the SYA campaign and/or from the award of a prize.
3. Participants are responsible for the correct submission of the data requested. If a participant is no longer able to be reached as a result of the submission of incorrect data, Lely shall not be held liable. In such a case, Lely shall also not be obliged to award any prizes.
4. By uploading a submission, participants cede all rights that could be attached to the submission including intellectual property rights, a worldwide, exclusive and perpetual licence to Lely for the use of the submission at Lely’s discretion, including the right to publish or reproduce the submission with or without naming the participant, anywhere in the world and using any medium.
5. By uploading a submission, participants guarantee that they have or have acquired any intellectual property rights required such as those on music or images used. Lely may under no circumstances be held liable for any alleged infringement of intellectual property rights committed by participants with a submission and the participant holds Lely harmless in this regard.
PERSONAL DATA
1. Personal data and/or name and address details provided to Lely by participants as part of the SYA campaign can be saved in Lely’s records and handled in accordance with the (Dutch) Data Protection Act.
FINAL PROVISIONS
1. Any questions or complaints relating to these campaign conditions and the SYA campaign can be sent by e-mail to communications@lely.com including a reference to the Share Your Advice Campaign.
2. Lely reserves the right at any time to amend the SYA campaign and/or the campaign conditions, to terminate the SYA campaign early and/or to cancel it at Lely’s discretion and the participant may submit no claims against Lely in this respect. Lely advises participants to keep a record of any amendments made on experts.lely.com.
3. These campaign conditions are governed by the law of the Netherlands. Any disputes arising from or in any other way connected with the SYA campaign or experts.lely.com shall be brought before the competent courts of Rotterdam.
